1. Acceptance of Terms

These Terms & Conditions ("Terms") govern your access to and use of the West Labs Rx website, patient portal, and related services (collectively, the "Services"). By creating an account, submitting an intake form, or using any part of the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

West Labs Rx provides a technology platform that connects you with independent, licensed healthcare providers and licensed pharmacies for telehealth evaluation, treatment, and prescription fulfillment. West Labs Rx is not itself a medical practice or pharmacy.

2. Eligibility

The Services are available only to individuals who are at least 18 years of age and physically located in a U.S. state where the Services and the relevant treatments are available. Treatment availability varies by state and may change. You agree to provide accurate, current, and complete information during registration and intake, and to keep it up to date.

3. Telehealth Services and Medical Care

All medical services, including evaluations, diagnoses, and prescriptions, are provided solely by independent, licensed healthcare providers. Telehealth has limitations: providers cannot conduct in-person examinations, and certain conditions require in-person care. A provider will evaluate whether telehealth is appropriate for your situation, and treatment is provided only when the provider determines it is medically appropriate.

Nothing on this website constitutes medical advice, diagnosis, or treatment, or creates a provider–patient relationship. A provider–patient relationship is created only after you complete an evaluation with a licensed provider. Do not delay or disregard professional medical advice because of anything you have read on this website. In a medical emergency, call 911.

4. Prescriptions and Fulfillment

Any prescription issued through the Services is at the sole discretion of the evaluating provider. Submission of an intake form, payment, or a subscription purchase does not guarantee a prescription, approval, or treatment. If a provider does not issue a prescription, you may be eligible for a refund of amounts charged for treatment not provided, as described in our Refund Policy.

Prescriptions are filled by independent, licensed pharmacies. West Labs Rx does not dispense medication. Delivery timelines are estimates and are described in our Shipping Policy.

5. Subscriptions, Billing, and Cancellation

Treatments are offered as monthly subscriptions. Your initial payment includes the first month of treatment, shipping, and the provider evaluation fee. Subsequent monthly renewals include the treatment and shipping unless otherwise stated at checkout.

Subscriptions automatically renew each month until cancelled. You may cancel at any time from your account or by contacting support, and cancellation takes effect at the end of the current billing period. By providing a payment method, you authorize recurring charges and agree to our Refund Policy. Prices are subject to change with notice before renewal.

6. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.

7. Acceptable Use

You agree not to misuse the Services, including by attempting to obtain prescriptions under false pretenses, reselling medications, scraping or reverse-engineering the website, interfering with its operation, or using the Services for any unlawful purpose. We may suspend or terminate accounts that violate these Terms.

8. Intellectual Property

All content on this website — including text, images, logos, and design — is owned by West Labs Rx or its licensors and is protected by intellectual property law. You may not reproduce, distribute, or create derivative works from it without prior written permission.

9. Disclaimers

The Services are provided "as is" without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the website will be uninterrupted, error-free, or secure. Statements about treatments have not been evaluated by the FDA unless a specific product is an FDA-approved medication, and nothing on this website guarantees results.

To the maximum extent permitted by law, West Labs Rx and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our aggregate liability for direct damages will not exceed the amounts you paid to us in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless West Labs Rx, its affiliates, and their personnel from claims, damages, and expenses arising from your violation of these Terms, your violation of any law, or your use of the Services.

11. Dispute Resolution

These Terms are governed by applicable federal and state law. Before pursuing formal action, you agree to contact us first so we can try to resolve the dispute informally. Where permitted, disputes will be resolved by binding arbitration on an individual basis, and you waive any right to participate in a class action. You may opt out of arbitration by notifying us in writing within 30 days of first accepting these Terms.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with a revised effective date, and continued use of the Services after changes take effect constitutes acceptance.
